By accessing or placing an order through the Grand Talon website (grandtalon.com.au), you agree to be bound by the following Terms and Conditions of Sale. These terms constitute a legally binding agreement between you and Grand Talon Pty Ltd (ACN 676 125 223), referred to herein as "Grand Talon," "we," "us," or "our." If you do not agree to these terms, please do not use this website or place any orders.

Grand Talon Pty Ltd operates in accordance with applicable Australian laws, including but not limited to the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), and the liquor licensing and responsible service legislation of each Australian state and territory in which we operate or make deliveries.

1. ACCEPTANCE OF TERMS 

Your use of this website and/or placement of an order constitutes your full and unconditional acceptance of these Terms and Conditions. Grand Talon reserves the right to amend these Terms and Conditions at any time without prior notice. It is your responsibility to review these terms periodically. Continued use of the website after any changes constitutes acceptance of the revised terms.

2. AGE VERIFICATION & RESPONSIBLE SERVICE OF ALCOHOL

Grand Talon Pty Ltd is committed to the responsible service and sale of alcohol.

2.1. It is unlawful to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. By placing an order on this website, you confirm that you are 18 years of age or older.

2.2. You further confirm that the person receiving the delivery is also 18 years of age or older. It is an offence to purchase or receive alcohol on behalf of a person under the legal age, including as a gift.

2.3. Grand Talon reserves the right to request valid photo identification from any customer or delivery recipient at the time of delivery. If proof of age cannot be provided, the delivery will be refused and the order cancelled, without refund of any applicable deliveryfees.

2.4. Grand Talon supports the Responsible Service of Alcohol (RSA). We reserve the right to refuse the sale or supply of liquor to any person we deem to be intoxicated, or to any person we believe intends to supply alcohol to a minor.

2.5. Australian Liquor Law Notice: Under the liquor legislation of each Australian state and territory, it is an offence to supply liquor to a person under the age of 18 years, and for a person under 18 years of age to purchase or receive liquor. Penalties vary by jurisdiction and may be significant. Grand Talon Pty Ltd complies with the liquor laws of all states and territories in which it operates.

3. PLACING ORDERS

3.1. All orders placed through grandtalon.com.au are subject to acceptance by Grand Talon Pty Ltd. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including where we suspect fraudulent activity, misrepresentation of age, or breach of these terms.

3.2. By submitting an order, you represent that all information provided is accurate, complete, and current. Providing false or misleading information — including misrepresentation of age — may result in the immediate cancellation of your order and potential referral to relevant authorities.

3.3. All prices displayed on this website are in Australian Dollars (AUD) and include applicable Goods and Services Tax (GST) unless otherwise stated. Prices are subject to change without notice. Errors and omissions in pricing are excepted, and Grand Talon reserves the right to correct any pricing errors and, where applicable, offer you the corrected price or cancel the order.

3.4. An order confirmation email does not constitute acceptance of your order. Acceptance occurs only when your order is dispatched.

3.5. Grand Talon reserves the right to limit the quantity of products available for purchase per customer or per order, particularly for limited-release or allocated products.

4. PAYMENT

4.1. Payment must be made in full at the time of placing your order. Grand Talon accepts major credit cards, debit cards, and other payment methods as displayed at checkout.

4.2. All transactions are processed through a secure, PCI-DSS-compliant payment gateway.

Grand Talon does not store your full credit card details.

4.3. Grand Talon reserves the right to request additional verification, including photo ID and credit card information, to validate your identity and order for security purposes. Failure to comply with such requests may result in order cancellation.

5. DELIVERY & SHIPPING

5.1 Domestic Delivery (Australia)

Grand Talon delivers to most locations across Australia via third-party courier services.

•Standard delivery timeframes are between 2–10 business days from dispatch, depending on your location. Remote and regional areas may experience longer delivery times.

•Delivery is made to the address provided at the time of ordering. It is your responsibility to ensure the delivery address is accurate. Grand Talon is not responsible for orders delivered to an incorrect address provided by the customer.

•A signature may be required upon delivery. If no one is available at the delivery address to sign for the parcel, the courier may leave a card with instructions for collection or redelivery. Additional redelivery charges may apply.

•Alcohol cannot be left unattended at a delivery address. If the order cannot be delivered due to the recipient being unavailable or unable to produce proof of age, redelivery fees will be the responsibility of the customer.

•Grand Talon will not dispatch orders during periods of extreme heat that may damage temperature-sensitive products. We will contact you to advise of any delay and hold your order until suitable conditions are available. If you request dispatch regardless of temperature, please note that heat-damaged products are not covered under any warranty or guarantee.

•If you have a dispute or concern regarding a delivery, you must contact us within 14 days of the stated delivery date. We are unable to investigate or resolve disputes raised after this period.

5.2 Availability & Stock

All products are subject to availability. If an item you have ordered is unavailable or out of stock, we will notify you within 2 business days and offer an agreeable alternative, a backorder arrangement, or a full refund. Grand Talon does not guarantee the availability of any product listed on the website.

5.3 International Shipping

International delivery is available to selected countries. Please check the website or contact us prior to placing an international order to confirm we can deliver to your country.

•All international orders are subject to the import laws, customs regulations, and liquor licensing requirements of the destination country. It is the customer's sole responsibility to ensure that importing alcohol to their country is lawful.

•International duties, taxes, and customs charges are not included in the product price or shipping fee displayed at checkout. These charges are the sole responsibility of the customer and are determined by the destination country's customs authority.

•If customs authorities in the destination country refuse or return a shipment to Grand Talon, we will refund the product value less the outbound shipping charge and a $50 AUD processing fee.

•Grand Talon cannot be held responsible for any delays, losses, or additional charges arising from customs clearance processes.

6. RETURNS, REFUNDS & EXCHANGES

6.1 Your Rights Under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.


6.2 Change of Mind

Grand Talon is not required to provide a refund or exchange where you have simply changed your mind, made a wrong selection, or no longer require the product. Please choose carefully before placing your order.

6.3 Faulty or Incorrect Products

If you believe a product is faulty (for example, a corked or damaged wine), you must retain the contents of the bottle and contact us within 14 days of delivery to arrange a resolution. Grand Talon will assess each claim individually and, where applicable, offer a replacement, store credit, or refund at our discretion. We may require the return of the product and/or photographic evidence before a resolution is provided. Return freight charges may apply in certain circumstances.

6.4 Damaged in Transit

If your order arrives visibly damaged, please photograph the packaging and products immediately and contact us within 48 hours of delivery. We will investigate and work with you to find an appropriate resolution. Please note that minor label scuffing or light packaging wear during transit is not considered a product defect and does not qualify for a refund or replacement.

6.5 Order Cancellations

Order cancellations requested after an order has been processed and dispatched may incur a cancellation and restocking fee of up to $50 AUD at Grand Talon's discretion. Special-order or allocated products cannot be cancelled once ordered.

7. PRODUCT INFORMATION & IMAGES

7.1. All product descriptions, tasting notes, vintage information, and images displayed on this website are provided in good faith and for illustrative and informational purposes only. While every effort is made to ensure accuracy, Grand Talon does not warrant that product descriptions or images are error-free, complete, or current.

7.2. Label designs, packaging, and vintage years may vary from those depicted on the website. Images should not be relied upon as an exact representation of the product you will receive.

7.3. Tasting notes and ratings represent the opinions of the author at the time of writing and are subjective in nature. Personal preferences vary, and a rating does not guarantee that you will enjoy the product. "I don't like it" does not qualify as grounds for a refund or return.

7.4. Older and back-vintage wines are sold in good faith but are not guaranteed in any way. Flavour profiles in aged wines can change significantly over time. If you are unfamiliar with the characteristics of older wines, we recommend seeking advice before purchasing.

8. PRODUCT STORAGE & HANDLING

Grand Talon recommends storing all products in a cool, dark environment away from direct sunlight, heat sources, and vibration. Ideal storage temperatures for most wines are between 12–18°C. Grand Talon accepts no responsibility for product quality loss resulting from improper storage conditions after delivery.

9. INTELLECTUAL PROPERTY

All content on this website, including text, images, graphics, logos, and product descriptions, is the property of Grand Talon Pty Ltd or is used under licence, and is protected under Australian copyright law. No content may be reproduced, distributed, or otherwise used without the prior written consent of Grand Talon Pty Ltd.

10. PRIVACY & COMMUNICATIONS

10.1. Grand Talon Pty Ltd is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

10.2. By entering your email address at checkout or when subscribing via our website, you consent to being added to our marketing database. We may contact you with news, promotions, product releases, and other information about Grand Talon.

10.3. You may opt out of marketing communications at any time by clicking the unsubscribe link in any email, or by contacting us directly at sales@pearlred.com. Opting out of marketing communications does not affect transactional communications related to your orders.

10.4. Grand Talon will not sell, rent, or share your personal information with third parties for their own marketing purposes without your explicit consent.

11. RESPONSIBLE CONSUMPTION & SELF-EXCLUSION

Grand Talon promotes the responsible consumption of alcohol. If you believe you or someone you know may have a problem with alcohol, we encourage you to seek appropriate support. You may self-exclude from our marketing and purchase communications at any time by contacting us at sales@pearlred.com. Resources are available through Drinkwise Australia at drinkwise.org.au.

12. LIMITATION OF LIABILITY

12.1. To the extent permitted by law, Grand Talon Pty Ltd shall not be liable for any indirect ,incidental, special, or consequential damages arising from the use of our website, products, or services.

12.2. Grand Talon's total liability in connection with any product or order shall not exceed the purchase price paid for that product or order.

12.3. Grand Talon does not warrant that the website will be available, uninterrupted, secure ,or error-free at all times.


13. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Commonwealth of Australia. Grand Talon Pty Ltd operates in accordance with all applicable federal and state legislation, including the Australian Consumer Law (ACL) as set out in the Competition and Consumer Act 2010 (Cth), the Privacy Act 1988 (Cth), and the liquor licensing laws of each state and territory in which we operate or deliver. Any disputes arising from these terms or your use of our website shall be subject to the jurisdiction of the courts of the relevant Australian state or territory, as applicable to your location.
